General Terms and Conditions
1. Scope of Application
These Terms and Conditions (T&Cs) apply to all services provided by NutriMedix Ltd,
86 Main Street, St Julian’s STJ 1015, Malta (hereinafter referred to as the “Provider”),
to patients and clients worldwide.
They apply to both medical and non-medical services.
Deviating terms and conditions of users do not apply unless expressly approved in writing by the Provider.

2. Scope of Services
The Provider offers the following services:

Telemedical consultations and follow-up appointments

Medical consultations including diagnosis, prescription and medication management
-
Nutrition and supplement counselling, and creation of individual nutrition plans
-
Organisation of laboratory tests (in cooperation with partner laboratories)
-
Retreats and health-related events (subject to separate conditions)
Medical services are provided exclusively by licensed physicians registered with the Medical Council Malta,
according to medical discretion and based on the information provided by the patients.
Telemedical consultations do not replace a physical examination if such is medically required,
and do not substitute general practitioner or emergency medical care.
Services are provided in compliance with the applicable legal provisions, medical confidentiality,
and the duties of care under the Health Care Professions Act (Cap. 464) and relevant EU regulations for telemedicine.
Notice regarding medical emergencies:
The Provider’s services do not include emergency treatment or acute medical care.
In the event of a medical emergency or life-threatening symptoms, patients are required to call the local emergency number immediately or go to the nearest emergency department.
This particularly applies to sudden or severe symptoms such as chest pain, shortness of breath, loss of consciousness, or acute allergic reactions.
3. Appointment Booking and Cancellations

Appointments can only be booked via the Provider’s website.

Appointments may be cancelled free of charge up to 24 hours before the scheduled time.

For cancellations made after this period or for no-shows, the full fee will be charged.

In case of no-shows without prior notice, the appointment will be considered as provided.
4. Fees and Payment Methods

The applicable prices are stated on the Provider’s website.

Payments are made in advance via PayPal or credit card.

For subscription models, monthly billing is carried out in advance.

In case of non-payment, the Provider reserves the right to withhold services.

All prices are quoted in euros and include VAT, where applicable.
5. Subscriptions
-
Subscriptions have no minimum term and may be cancelled at any time with effect at the end of the current month.

Monthly fees already paid are non-refundable.

Cancellations must be submitted in text form (e.g. by email to info@nutri-medix.com).

Cancellation takes effect at the end of the current billing period.
6. Prescriptions
-
Prescriptions are issued exclusively for the individual patient.
-
Any transfer, resale or misuse of issued prescriptions is strictly prohibited and may result in legal consequences.

Prescriptions are issued only after medical evaluation and are subject to professional assessment.
7. Liability
-
The Provider is liable for damages only in cases of intent or gross negligence,
as well as for breaches of essential contractual obligations. -
In cases of slight negligence, liability is limited to the foreseeable, typical damage.

Liability for damages resulting from injury to life, body or health remains unaffected.

Any further liability is excluded.

The Provider assumes no liability for damages caused by incomplete, incorrect, or omitted information provided by the patient.
-
The implementation of nutritional recommendations and behavioural changes remains the sole responsibility of the patient.
8. Right of Withdrawal

For online bookings, the statutory right of withdrawal for distance contracts applies.
-
However, the right of withdrawal expires once the Provider has begun performing the service with the explicit consent of the patient,
and the patient has confirmed their awareness of losing the right of withdrawal upon commencement of the service
(Art. 16(c) EU Consumer Rights Directive / § 356(4) BGB by analogy).
9. Data Protection
The processing of personal data is governed by the Provider’s published Privacy Policy available on the website.

10. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Malta.
-
The place of jurisdiction is Valletta, Malta, where legally permissible.
-
Mandatory consumer protection provisions of the patient’s country of residence remain unaffected.
11. Final Provisions
-
Should any provision of these Terms and Conditions be or become invalid,
the validity of the remaining provisions shall not be affected. -
Amendments or additions to these Terms and Conditions must be made in writing.
-
No verbal side agreements exist.
